Mandatory Forms under the Condominium Act

The Ontario government is currently proposing to transfer control over the content and formatting of 19 of the mandatory Forms under the Condominium Act, from the Ministry of Government and Consumer Services (the "Ministry") to the Condominium Authority of Ontario (the "CAO").

The provincial government is asking for feedback from the public on this proposed change, by no later than Monday September 30th 2019. Public comment can be provided via email, as per the Ontario government's posting here.

Ever since the mandatory Forms were first released by the Ministry on November 1st 2017, many stakeholders in the condominium industry have expressed various concerns about the formatting and required content of such prescribed Forms. For example, there remains to this day, plenty of confusion about how to properly complete a Proxy Form for a Meeting of Owners.

Accordingly, we encourage all stakeholders – whether a unit owner, a condominium board member, a condominium manager, or an interested industry professional – to provide their public comment on whether they believe that the responsibility for these 19 mandatory Forms should be delegated to the CAO instead of the Ministry.
