Protecting your Condominium from Occupier’s Liability
Andrea M. Thielk, B.A., LL.B., J.D., A.C.C.I.

Know what you’re responsible for. The first place you should look to determine your responsibility as an occupier of condominium property is your provincial legislation on condominiums and on occupiers’ liability. In Ontario, the Condominium Act of 19981 at section 1 defines

"common elements" as all areas that are not units; and

"unit" means a part of the property designated as a unit by the description and includes the space enclosed by its boundaries and all of the land, structures and fixtures within this space in accordance with the declaration and description.

Q: Without full information and appropriate discussion, our board has approved a formula of assessments as was indicated following a reserve fund study. In 2002, our fund was in excess of $125,000 and the next assessments foreseen in the study are in 2009 and 2010 for amounts of $125,000 and $250,000 respectively. We only have 19 units, making these amounts quite significant.

Is it true that, since the future funding plan has been approved, smaller assessments at regular intervals until 2009 to avoid depletion of the reserve fund cannot be made unless
another fund study is undertaken?

May 8, 2007 ACMO - Ask the Expert - Use of Condo Unit Andrea M. Thielk, B.A., LL.B., J.D., A.C.C.I. Q: I own a townhouse condo in Waterloo, Ontario. I am currently running a babysitting service out of my home. I now have the board breathing down my back stating that I am causing extra liability to the corporation due to extra children and parent traffic. As well I am making profit from common expenses. The water is part of my condo fees; I do not pay for it separately. They have told me I have until June 06 to close down my babysitting business. They are putting together a new rule and bringing up at the annual general meeting. Can they do this to me? What is my legal right as a home owner? they need a bylaw? How many must be in favour? download
